Federal Court Punts Apple v. Samsung Back to Judge Koh, Citing Overly Restrictive Causal Nexus Standard

On November 18th, the Federal Circuit ruled on the Northern District Court of California’s decision, which denied Apple’s request for a permanent injunction. It affirmed the finding that Samsung did not infringe Apple’s design patents but vacated the denial of injunctive relief for utility patents. The decision turns on the the causal nexus between ongoing infringement and irreparable harm.

ACLU Sues DOJ Over FISA Surveillance Evidence

ACLU v. U.S. Dep’t of Justice

The ACLU filed a complaint against the United States Department of Justice seeking immediate processing and release of DOJ records that the ACLU had requested pursuant to the Freedom of Information Act earlier this year. The requested information relates to the use of evidence derived from surveillance authorized under the FISA Amendments Act. The ACLU also seeks a fee waiver on the grounds that disclosure of the requested records is in the public interest.
